1- SUBJECT – ENFORCEABILITY OF THE GSV

1.1 These general conditions of sale (hereinafter the « GCS ») are entered into between, on the one hand, Société Auto Moto Cycle Promotion, owner of the « Mondial de l’Auto 2024 », hereinafter the « Mondial 2024 », which has granted an exclusive operating licence and entrusted the organisation of the Mondial 2024 to HOPSCOTCH CONGRES (RCS 422 322 479, intracommunity VAT no. FR 09 422 322 479), a Société par Actions Simplifiée (simplified joint stock company), whose registered office is at 23-25 rue Notre-Dame-des-Victoires, 75002 Paris, the vendor, hereinafter referred to as « HOPSCOTCH CONGRES » and, on the other hand, any customer, hereinafter referred to as the « Purchaser », purchasing one or more tickets, hereinafter referred to as the « Ticket(s) », representing a right of access to the Mondial 2024.

1.2 The purpose of the GTC is to define the terms and conditions under which the Purchaser acquires from HOPSCOTCH CONGRES, online via a dedicated ticketing portal, hereinafter the « Ticketing Portal », from approved partners, hereinafter the « Approved Partners », or, in the event that this is offered by the organiser, on site at the Mondial 2024 site at Porte de Versailles in Paris, hereinafter the « Site », one or more Ticket(s) allowing access to the Mondial 2024, as well as the terms and conditions for using these Tickets.

1.3 No special conditions or general terms of purchase may take precedence over these GTCS.

1.4 Any order and purchase of Tickets implies the Purchaser’s full and unreserved acceptance of the GTC. In order to confirm this acceptance when ordering Tickets via the Ticketing Portal, the Purchaser must tick the box provided for this purpose on the online form accessible from the Ticketing Portal and validate his/her acceptance of the GTCs by means of a tick box. If they fail to do so, their order cannot be taken into account. The Buyer may, at any time, consult or print out the current GTC, available on the Ticketing Portal page by clicking on the « GTC » tab. The GTC applicable to an order are, in all cases, sent to the Buyer by email via a link stipulated in the Order Confirmation email. The Purchaser declares that he/she has full legal capacity and/or any authorisation that may be necessary to enter into such an agreement. The purchase of a Ticket, together with the fact of entering the Site hosting the MONDIAL 2024 by means of the Ticket, constitutes irrevocable acceptance of the Site’s internal regulations, hereinafter the « Site’s Internal Regulations ».

1.5 It is the responsibility of the Purchaser to bring the GTCs to the attention of any Ticket Holder(s) and to obtain their undertaking to comply with said GTCs. Thus, the rights and obligations resulting from the GTCS are automatically applicable to any Ticket Holder, by the effect of the transfer of the Ticket under the conditions provided for in article 8 of the GTCS below.

 

 

2- DEFINITIONS

Buyer
Any natural person aged 18 or over who has the legal capacity to enter into a contract relating to the purchase of a Ticket for the 2024 World Cup in accordance with the General Terms and Conditions of Sale.

Buyer cancellation insurance / Ticket cancellation guarantee / Ticket cancellation protection
Cancellation insurance offered as an option when the Ticket is purchased online and which gives the possibility of having the said Ticket reimbursed in the event that the Ticket cannot be used for a particular reason and in accordance with the contractual conditions accepted when the Ticket was purchased. This insurance is underwritten by HOPSCOTCH CONGRES, through its partner PHENOMEN (SASU with capital of €10,000, whose registered office is located at 141 avenue de Wagram 75017 Paris, registered with the Paris RCS under no. 833 740 699 and with the ORIAS under no. 18000514,) which distributes the Meetch insurance product, with the insurer SEYNA (SA with capital of €1.115,800.42 whose registered office is at 20 bis rue Louis Philippe 92200 Neuilly sur Seine, registered with the Nanterre Trade and Companies Register under no. 843 974 635, an insurance company governed by the French Insurance Code). Ticket
Individual and nominative ticket purchased online from HOPSCOTCH CONGRES, via the Mondial Ticketing Portal, from the Approved Partners, allowing access to the Mondial 2024 on the day and, where applicable, to a specific Time Slot, in accordance with the conditions stated on the Ticket and issued in the form of an electronic ticket (e-ticket) on which a QR code is displayed and which may, where applicable, be printed.  

General Terms and Conditions of Sale
These general terms and conditions of sale govern the relationship between HOPSCOTCH CONGRES, on the one hand, and Ticket Holders, on the other hand, with regard to the purchase of Tickets on the Ticketing Portal or on the Site and their use, to the exclusion of any other document.

Niche
Means a time slot for arrival on the Site on a given day and corresponding to a period of validity during which certain Tickets are considered valid for access to the Mondial 2024. The Slots vary according to the type of Ticket held by the Ticket Holder, in accordance with the provisions of these GTC. The Slot that may be associated with a Ticket is indicated on said Ticket.

Ticket holder
Any person in regular possession of a Ticket, i.e. the Purchaser or, as the case may be, the Ticket Holder.
Includes all natural persons wishing to purchase Tickets and attend the 2024 World Cup.

2024 World Cup
Event open to the general public from 15 to 20 October 2024 on the Site and organised by HOPSCOTCH CONGRES. October 14 is dedicated exclusively to automotive professionals and the Press/Media.

Carrier
A natural person belonging to the Buyer’s private circle and to whom the Ticket(s) is/are sent by the Buyer in accordance with these GTC.

Ticketing Portal
Internet platform for online ordering and payment made available to Internet users by HOPSCOTCH CONGRES and its partner service provider, supplier of the online ticketing software, the company WEEZEVENT (SAS with share capital of 72,212 whose registered office is located at 14 rue de l’Est 21000 Dijon, registered with the Dijon Trade and Companies Register under number 503 715 401), for the purposes of selling and downloading Tickets.
The official Ticketing Portal is only available from the www.mondial.paris website.  HOPSCOTCH CONGRES is the only party authorised to offer the online sale of Tickets, unless authorised by an authorised partner (France billet, Ticketnet).

Purchase price
Total purchase price (including VAT) of the Ticket(s) allocated by HOPSCOTCH CONGRES in accordance with these GTC. This price includes VAT and does not include Buyer Cancellation Insurance, which may be taken out as an option, at the Buyer’s discretion, at the time of purchase of the Tickets.

Site rules
The Site’s internal rules, which define all the rules with which Ticket Holders present on the Site must comply (in particular the list of objects and behaviour not authorised on the Site). They set out the rights and obligations of Ticket Holders, who may consult them at the entrances to the Site.

Website
The official site of the Mondial 2024 includes all the areas to which access is subject to the presentation of a Ticket. On the date of publication of the General Terms and Conditions, the Official Site is located at Paris Expo Porte de Versailles, 12 place de la porte de Versailles, 75015 Paris.

 

 

3- TICKET SALES

3.1 General rules

3.1.1 All Ticket purchases require either the ordering of Ticket(s) by the Purchaser via the official Ticketing Portal or through the partner network, or the purchase of Ticket(s) by the Purchaser on the Site.

3.1.2 You are reminded that HOPSCOTCH CONGRES has exclusive rights to market the Tickets and is the only party authorised to appoint sales partners. Consequently, HOPSCOCTH CONGRES declines all responsibility for the sale of Tickets by any unauthorised third party, including on so-called « secondary » markets or via unauthorised websites.

3.1.3 The types of Ticket and the different prices available are indicated on the Ticketing Portal, on the « Practical Information » page of the www.mondial.paris website and on posters in the reception area of the Site.

3.2  Specific rules for ordering Tickets via the Ticketing Portal

3.2.1  Step 1 – The Purchaser who wishes to order one or more Tickets selects the day (date) and, as the case may be, the desired Arrival Slot which determines the start of validity of the Ticket(s) and adds them to his/her basket by clicking on the « Next » button.

3.2.2 Step 2 – The Purchaser selects the type and number of Tickets desired by type of Ticket. The Purchaser has the option of applying a promotional code and/or subscribing to the Cancellation Insurance option. The Purchaser has the option of modifying or deleting all or part of his/her basket before validating it via the « Next » button via the « Back » button and by returning to the previous steps.

3.2.3 Step 3 – The Purchaser is invited to indicate the surname and first name of the bearer for each Ticket and to select or not the optional cancellation insurance to be taken out. They proceed to the next step by clicking on the « Continue » button.

3.2.4 Step 4 – The Buyer is invited to fill in their contact details, to accept or refuse to give their consent to receive the newsletter, to request an invoice or not, to read the GTC and to validate them. The Buyer has the option of modifying or deleting all or part of their order by clicking on « Back ».

3.2.5 Step 5 – The Buyer checks his/her order and selects the payment method from those offered; he/she completes the required payment details. The different methods of payment are detailed in the « Payment » article of these GTC. To validate their order, the Buyer must click on the « Buy » button, which validates payment and definitively accepts the order.

3.2.6 A provisional confirmation of the order, including in particular the order number allocated, is presented to the Buyer on the Ticketing Portal. The Buyer receives an initial « Order Confirmation » email confirming the validation of his/her order, as well as an email from MEETCH if the Buyer has taken out cancellation insurance.

3.2.7 HOPSCOTCH CONGRES reserves the right not to accept an order in the following cases:

–  unavailability of all or part of the Tickets ordered ;
– existing dispute(s) with the Buyer, including in the event of total or partial non-payment of one or more of the Buyer’s previous orders;
– objective suspicion of fraud ;
– refusal of payment authorisation by banking organisations/partners
– manifest price error, when the price is considered derisory in relation to the value of the Ticket, in particular as a result of a parameterisation error, in accordance with case law considering that there was no meeting of the minds on the price as required by article 1583 of the Civil Code.

3.2.8 Unless the Order is refused in the aforementioned cases and notified by email, which invalidates the order, the Purchaser will receive a definitive confirmation of his/her order, which will always include a summary of his/her order, at the email address that he/she has provided. The sales contract between the Purchaser and HOPSCOTCH CONGRES is formed upon final confirmation of the order. Each Purchaser is required to provide at least the following information at the time of ordering: surname, first name, email address, postcode, country and telephone number relating to the Purchaser and the surname and first name relating, where applicable, to the Subscriber. It is the responsibility of each Purchaser to ensure that all of the data required for the purchase of a Ticket (in particular the email address which will enable the Ticket to be received before the opening of the Mondial 2024) is accurate and up to date and to modify it if necessary. In particular, HOPSCOTCH CONGRES shall not be liable in the event of an order not being validated, not being executed or being executed incorrectly due to missing or inaccurate information. For example, an erroneous or spammed email or an email that does not allow the Ticket to be received in time is the sole responsibility of the Purchaser.

3.2.9 The credit card used to pay for the Ticket via the Ticketing Portal must have a sufficient balance and a sufficient limit to cover the Purchase Price of the Ticket, including any bank charges invoiced for payment by credit card and the Buyer Cancellation Insurance if this is taken out by the Buyer at the time of the order in accordance with the contractual conditions of the Buyer Cancellation Insurance.

3.3 Ticket sales period

Ticketing for the 2024 World Cup via the Ticketing Portal and the Website is open from April 2024  until the last day of the 2024 World Cup, subject to availability, i.e. Sunday 20 October 2024. These dates are provided by HOPSCOTCH CONGRES for information purposes only. HOPSCOTCH CONGRES reserves the right to modify them. Information concerning the dates on which Tickets go on sale will be available on www.mondial.paris.

3.4 Quota

The number of Tickets offered for sale is limited and subject to a maximum quota.
Tickets may therefore become unavailable for sale during their sales period.
The Mondial 2024 ticketing service, via the official Ticketing Portal or the Site, will make its best efforts to inform the Purchaser in real time of the availability of the Tickets when he places his order or makes his purchase.
The Purchaser is hereby informed that he/she may not order more than 15 Tickets per type of Ticketexcept for pre-sale fares, PRM + Companion fares and children’s fares, where the quantity will be limited to 4 Tickets.
The Buyer is also informed that he/she will not be able to generate an order for more than 15 tickets in total.

3.5 Characteristics and type of Tickets

The essential characteristics of the Tickets are described on the Ticketing Portal. There are several types of Tickets offered for sale by HOPSCOTCH CONGRES. The purchase of these Tickets is subject to compliance with eligibility conditions by the Ticket Holder. It is the sole responsibility of the Purchaser to ensure that Ticket Holders comply with these eligibility conditions for the Ticket they hold. 

3.5.1 Pre-sale tickets and eligibility conditions
Ticket at a promotional rate within the limit of the available quotas put on sale, available only to any person aged 16 or over at the time of access to the Mondial 2024, in possession of an identity document which will be checked at the reception of the Mondial 2024.
Personal ticket, non-refundable, non-exchangeable.

3.5.2 Full price » ticket and eligibility conditions
This ticket is only available to anyone aged 16 or over at the time of entry to the Mondial 2024, with an identity document, which will be checked when the 2024 World Cup is hosted.
Personal ticket, non-refundable, non-exchangeable.

The ticket can only be used by a person aged between 7 and 15 years old at the time of access to the Mondial 2024, in possession of an identity document that will be checked at the reception of the Mondial 2024.The Holder of such a Ticket must(i) be accompanied by a person aged 18 or over at the time of access to the Mondial 2024, who must also be the Holder of a « Full Price or Pre-Sale » Ticket valid for the same date/Slot as that of the « Child » Ticket concerned and (ii) be able to prove that he/she has written authorisation from his/her parents or legal guardians to access the Mondial 2024.
Personal ticket, non-refundable, non-exchangeable.

3.5.4 0-6 years » ticket, and eligibility conditions
Tickets for children aged 0 to 6 are not published online.
It is the responsibility of parents or accompanying adults with written authorisation from their parents or legal guardians, holding a valid « Full Price or Pre-Sale » Ticket, to present themselves at the Mondial 2024 main reception desk and to enter the site via the line reserved for families with children aged 0 to 6 years.
An identity document will be checked at the Mondial 2024 reception desk to verify the child’s age.

3.5.5 Nocturne » tickets and eligibility conditions
This ticket is available to anyone aged 16 or over at the time of entry to the Mondial 2024, on presentation of an identity document which will be checked at the reception of the Mondial 2024. This ticket is subject to a specific arrival time. See article 3.6.

3.6 Slot(s) and validity period (first use of ticket)

Each Ticket allows access to the Mondial 2024 only on a specific day, from among the days offered by HOPSCOTCH CONGRES and selected by the Purchaser at the time of purchase. Only the day indicated on the said Ticket shall be deemed authentic.
Nocturne » tickets or tickets valid during the « Week End » are subject to more restricted arrival times.

4- TICKET VALIDITY AND ACCESS TO THE SITE

Please refer to the table in article 3.6.
As the Ticket is nominative, non-refundable (for paying Tickets) and non-exchangeable, the Ticket Holder wishing to gain access outside the period of validity of his/her Ticket must pay for a new Ticket at the price in force under the conditions of these GTC.

4.1 Cases of disability

In addition to the elements cited in articles 3.1, and articles 8 and 9 below of the GTCs, Tickets will be considered and rendered invalid, i.e. as not allowing access to the Mondial 2024 under the following conditions:
⮚ An identity check is carried out and the name on the Ticket is different from the name on the Ticket Holder’s identity document.
⮚ An identity check is carried out and the Ticket Holder’s age does not match the Ticket type.
⮚ An identity check cannot be carried out because the Ticket Holder does not have any official proof of identity (identity card, passport, driving licence).
⮚ A Ticket Holder aged 0-6 is not accompanied by a Ticket Holder aged 18 or over, or the Ticket Holder is not in possession of a valid Ticket.
⮚ The 7-15 year-old Ticket Holder is not accompanied by a Ticket Holder aged 18 or over, or the Ticket Holder is not in possession of a valid Ticket.
⮚ The Ticket has already been scanned to enter the Site. There cannot be two identical Tickets scanned at the same time and/or in different areas of the Site.
⮚ The Ticket has not been scanned on leaving the Site. It is therefore considered to be already present on the Site.
⮚ The ticket was scanned for the first time over 7 hours ago.

It is the sole responsibility of the Ticket Holder to :
⮚ Do not purchase it anywhere other than the Ticketing Portal or official partners of the Mondial 2024.
⮚ Do not share it with anyone other than the person intended to carry it.
⮚ Comply with the compulsory checks on entering and leaving the Site and ensure that the Ticket has been scanned correctly.

4.2 Other cases of disability
Apart from one small rucksack or handbag per Ticket Holder, all luggage is prohibited on the site.
The same applies to a list of prohibited products and objects on the www.mondial.paris website.
Valid Ticket Holders arriving with baggage must deposit it, at their own expense, in a baggage storage facility before gaining access to the halls.
Any Ticket Holder who is carrying one or more products or objects considered to be prohibited must leave them permanently with the security personnel at the bag checks at the entrance to the Site.
Ticket Holders who do not wish to comply with these rules will not have access to the Site. They may not demand a refund of their Ticket or any other damages and interest.
Finally, any Holder of a valid Ticket who, in the opinion of HOPSCOTCH CONGRES, including its staff and its service providers appointed for the organisation of the Mondial 2024, displays an attitude or behaviour that endangers or could endanger the safety of the visitors or organisers of the Mondial 2024, will be asked to leave the Site. Their Ticket will also be invalidated. He/she may not demand a refund of his/her Ticket or any other damages and interest.

4.3 Site access
Holders of a valid Ticket benefit from :
⮚ a right of access to the various indoor and outdoor areas of the Site
⮚ for those with a valid driving licence, the right to book a test drive at a dedicated booking point, subject to the availability of such a service
⮚ access to the various outdoor activities organised by and for the Mondial 2024 on the Site
⮚ access to catering facilities inside and outside the Site

 

5- TICKET INSURANCE

5.1 General rules
The Ticket is personal, non-transferable, non-exchangeable and non-refundable (for paying Tickets) unless expressly provided otherwise in these GTC.

5.2 Buyer cancellation insurance

Please note that no insurance is included in the price of Tickets.
HOPSCOTCH CONGRES can only recommend that the Purchaser take out insurance covering certain cases of impossibility of access to the Mondial 2024 on the day and, if applicable, during the Time Slot indicated on the Ticket. For this purpose, Buyer Cancellation Insurance is offered as an option at the time of purchase of a Ticket by a partner of HOPSCOTCH CONGRES, PHENOMEN, an insurance broker, with the insurer SEYNA. This is a contract concluded between the insurer SEYNA and the Purchaser. The Purchaser is hereby informed that HOPSCOTCH CONGRES acts only as a simple intermediary on an ancillary basis in accordance with article L. 513-1 of the French Insurance Code and that PHENOMEN acts as manager of the insurance contract.

The conditions of the Buyer Cancellation Insurance are therefore offered on the Ticketing Portal by the insurer SEYNA and are subject to the latter’s contractual conditions, which must be accepted in order to validate the subscription.

The Purchaser alone decides whether or not to take out this Purchaser Cancellation Insurance, having taken the time to read the notice and the insurance conditions and to accept the terms posted online on the Ticketing Portal by ticking the « take out cancellation insurance » box.

Purchasers who have taken out, with their express agreement, the Purchaser Cancellation Insurance, pay the amount of the insurance in full at the same time as they pay for their order of Tickets. Any reimbursement or retraction relating to Cancellation Insurance is managed by PHENOMEN or SEYNA in accordance with the insurance conditions.

Any claim made by the Purchaser must be made solely to the insurer SEYNA, or PHENOMEN in accordance with their contractual conditions, to the exclusion of HOPSCOTCH CONGRES, which shall not incur any liability in this respect. In the event of cancellation accepted by the SEYNA insurer, HOPSCOTCH CONGRES will invalidate the Ticket concerned.

 

 

6- PAYMENT

6.1 General rules
The Tickets remain the property of HOPSCOTCH CONGRES until the effective and final receipt of the purchase price of said Tickets is recorded.
You are reminded that in the event of non-payment of Tickets ordered on the Ticketing Portal which is not remedied by the Purchaser, HOPSCOTCH CONGRES reserves the right not to validate the order concerned.
Exchanges with the Ticketing Portal are secured by SSL encryption. The Purchaser’s bank details are neither visible nor kept by HOPSCOTCH CONGRES or its partner Weezevent.
Online electronic payments are made via the Ticketing Portal or directly on the website of HOPSCOTCH CONGRES’ banking partner, which ensures security using appropriate encryption and authentication technologies. 

6.2 Payment via the Ticketing Portal
The Purchase Price of the Tickets is indicated in euros, inclusive of all taxes, in accordance with the grid stipulated in article 3.7 of the GTC.
Ticket prices are payable by credit card (VISA, CB, MASTERCARD) only.
E-cards or virtual cards are not accepted. Any payment incident will automatically invalidate the order.

6.3 On-site payment
No ticket sales on site. Tickets can only be purchased online.

 

 

7- OBTAINING TICKETS, INVOICING AND ARCHIVING

7.1 Sales via the Ticketing Portal
The Tickets and, if applicable, the invoice requested will be sent to the Purchaser at the email address that he/she provided at the time of the order in the run-up to the 2024 World Cup within a period of 15 to 7 days before the first official day of the 2024 World Cup.
In accordance with article L.213-1 of the French Consumer Code, HOPSCOTCH CONGRES archives the sales contract concluded with the Purchaser for a period of ten (10) years from the date of transmission of the Ticket(s) concerned for any order on the Ticketing Portal for an amount greater than €120.

7.2 On-site sales
No ticket sales on site. Tickets can only be purchased online.

7.3 Archiving
In any event, in accordance with article L.213-1 of the French Consumer Code, HOPSCOTCH CONGRES shall, for any order on the Ticketing Portal for an amount in excess of €120, archive the sales contract concluded with the Purchaser for a period of ten (10) years from the transmission of the Ticket(s) concerned.

 

 

8- SPECIFIC CONDITIONS FOR THE USE OF TICKETS

8.1 The resale/offer to resell or the exchange/offer to exchange a Ticket, even free of charge, is strictly prohibited. Furthermore, as the Ticket is nominative, it may not be transferred to a third party. This principle of prohibition does not apply to the transfer or resale of a Ticket by a Purchaser to the Bearer of said Ticket.

8.2 In the case of a purchase made for one or more Subscriber(s), the Purchaser may transfer the Ticket free of charge to the Subscriber(s) concerned. In addition, a transaction may take place if and only if the Purchaser resells his/her Ticket(s) on a personal basis to the Subscriber(s) concerned and for an amount that does not exceed the Purchase Price and on the condition that the Subscriber(s) accepts the GTC.

8.3 It is forbidden to carry out any promotional or commercial activity in relation to the Tickets without the prior agreement of HOPSCOTCH CONGRES. Consequently and in particular, it is forbidden to:
-For any Ticket Holder or other third party to carry out advertising or promotions in connection with the 2024 World Cup;
-For all Ticket Holders to display commercial messages on any medium taken from the Site, and in particular on their clothing;
-To carry out promotional activities for any brand,
To use the Tickets for any promotion, advertising, fundraising, auction, tombola, for commercial or non-commercial purposes;
– Use the Tickets as a prize (or part of a prize) in any contest, competition, (promotional) game of chance, lottery or sweepstakes;
– To combine and sell Tickets as part of a package of goods or services; including as part of a travel or accommodation/hotel package (for example a combined flight-hotel-Ticket package).

8.4 The conditions of use of the Tickets are as follows:

– It should be noted that each Ticket is only valid for the date and, where applicable, for the time slot defined (night Ticket, weekend Ticket with arrival in the morning or afternoon). See Article 3.6.
– Tickets cannot be reimbursed, taken back or exchanged, even in the event of loss or theft.
– In order to enter the Site, Ticket Holders must scan their Ticket as they enter and leave the Site.
– If a Ticket is presented in paper format, any Ticket that has been scratched, damaged, crossed out or altered will be refused.
– Any exit from the Site is final.

8.4.1 The Ticket Holder must have a mobile terminal such as a smartphone or touch-sensitive tablet in working order on which he/she will have downloaded the Ticket in order to present it to the control teams responsible for controlling access and the validity of the Ticket (the control will relate to the Ticket in its entirety and not just to the QR code). As a precaution, and in order to avoid any inconvenience caused by incorrect downloading of the Ticket or malfunctioning of the mobile terminal used, it is strongly recommended that the Ticket be printed in portrait on blank white A4 paper (front and back), without changing the print size, using an inkjet or laser printer. Any Ticket that is partially printed, soiled, damaged or illegible shall not be considered valid. HOPSCOTCH CONGRES declines all responsibility for anomalies occurring during the printing of the Ticket or a faulty downloading of the Ticket or a malfunction affecting the Ticket Holder’s terminal enabling the Ticket to be read.

8.5 Once inside the Site, the Ticket Holder must keep the Ticket in all circumstances.

 

 

9- BEHAVIOUR ON THE SITE

Any behaviour by a Ticket Holder that is contrary to articles 8 and 9 of the GTCs will result in the cancellation of his/her Tickets, without him/her being able to claim reimbursement for the cancelled Tickets.

9.1 For security reasons, Ticket Holders present on the Site, at the request of the accredited personnel in charge of security, must :

– Present their Ticket valid in the name of the Ticket Holder concerned, together with proof of identity so that their identity can be checked;
– Submit to inspections, palpations and checks as requested. Accredited security personnel are authorised to search the clothes and/or belongings of Ticket Holders with their authorisation (in the event of a categorical refusal by the Ticket Holder, access to the Site will be refused);

9.2 It is strictly forbidden on the Site to express, disseminate or display objects or messages that may infringe the rights of others, whether xenophobic, sexist, religious, political or otherwise prohibited by law.

9.3 The Ticket Holder must comply with all the provisions of the Site’s Internal Regulations.

9.4 Unless authorised by HOPSCOTCH CONGRES, access to areas of the Site that are closed to the General Public or reserved for accredited personnel or Ticket Holders is strictly forbidden. More generally, Ticket Holders must remain in the area corresponding to their Ticket.

9.5 HOPSCOTCH CONGRES, as the official organiser of the Mondial 2024, holds in this capacity all of the exploitation rights relating thereto and, in particular, all of the intangible elements produced during or resulting from the staging of the Mondial 2024. As a consequence of the foregoing, any Ticket Holder present on the Site is formally prohibited from collecting, storing, distributing, communicating, publishing, delivering and/or making available to any person or any third party organisation whatsoever, by any process whatsoever and from any place on the Site whatsoever, whether free of charge or for a fee, any data, statistics, information or facts relating to the Mondial 2024 of which he/she becomes aware on the Site. In the event of a breach of the prohibition set out in this article, the offender shall be liable to one or more of the penalties set out in article 9.6 below, and HOPSCOTCH CONGRES reserves the right to institute any proceedings or actions against the offender.

9.6 Ticket Holders who fail to comply with the above provisions will be subject to the following measures:

– be refused entry to the Site (immediate expulsion),
– legal action by HOPSCOTCH CONGRES in accordance with applicable legislation.

The foregoing stipulations are without prejudice to any other action that HOPSCOTCH CONGRES may bring for obtain compensation for the damage suffered. 

 

 

10- GUARANTEES, CANCELLATION AND FORCE MAJEURE

10.1 HOPSCOTCH CONGRES must be informed in writing of any case of a defective Ticket, for example where the indication of the name of the Ticket Holder is illegible or non-existent, upon receipt of said Ticket (by email or, in the case of sales on the Site with a print request, upon receipt of the printed version on the Site).
Once the Ticket has been delivered to the Purchaser, HOPSCOTCH CONGRES may not be held liable for the loss, theft, damage or destruction of the Ticket. In particular, HOPSCOTCH CONGRES shall not be obliged to make any refund of the Ticket.

As the purchase of a Ticket via the Ticketing Portal constitutes a provision of services that must be provided within a given period, in accordance with the provisions of article L.221-28 of the French Consumer Code, Tickets purchased via the Ticketing Portal may not be subject to a right of withdrawal.

10.2 HOPSCOTCH CONGRES may not be held liable in the event of the definitive cancellation, temporary or definitive stoppage or postponement of all or part of the Mondial 2024, or in the event of a change of venue due to force majeure, in particular when the cancellation, stoppage or postponement is made necessary for safety or public health reasons, or by decision of any competent authority. In such cases, HOPSCOTCH CONGRES shall not be entitled to any reimbursement, damages or compensation.

10.3 If the Mondial 2024 is postponed to a date other than that reserved by the Purchaser, the initial Ticket shall remain valid for attendance on the new date set by HOPSCOTCH CONGRES.

10.4 If the Purchaser does not wish to use his/her Ticket on the new date thus set, HOPSCOTCH CONGRES will only reimburse the Tickets upon request sent to [email protected] and solely for the benefit of the Purchaser (and not for the benefit of any Bearer(s)). The refund will be made to the card used for the original payment.

10.5 In the event that HOPSCOTCH CONGRES decides, at any time whatsoever, to cancel or relocate the Mondial 2024 scheduled on the Site, any Purchaser may also make a request for reimbursement to the address indicated in article 10.4 above.

 

11- IMAGE AND SOUND RECORDING

11.1 All Ticket Holders present on the Site expressly authorise HOPSCOTCH CONGRES, or any other natural person or legal entity that it may substitute, to capture their image and voice in any form such as photographs, audio recordings or videos.

11.2 The Ticket Holder who has been the subject of such a recording transfers to HOPSCOTCH CONGRES, free of charge, for the entire world and for a period of ten (10) years from the time of the recording, the right to use said recording for the internal and external communication needs of HOPSCOTCH CONGRES and the Mondial 2024, in whole or in part, incorporated in or associated with any works or elements, by any means of distribution known or unknown to date (such as, in particular, the Internet), on any medium (book, brochure, DVD, etc.), by any process and in any format (print, electronic, etc.).) by any process and in any format (paper, digital, etc.), for commercial or non-commercial purposes. HOPSCOTCH CONGRES may thus reproduce the recordings, communicate them to third parties and adapt them.

11.3 The present Ticket Holder may under no circumstances record, use or distribute a recording of all or part of the Site or a description of the Site for anything other than private purposes.

 

12- MISCELLANEOUS

12.1 Changes to the General Terms and Conditions

Before the start of the Mondial 2024, HOPSCOTCH CONGRES reserves the right to modify, if necessary, these GTC in order, in particular, to guarantee the smooth running of the Mondial 2024, to adapt to regulatory and legislative developments and to the development of the Portal.
HOPSCOTCH CONGRES undertakes to inform the Buyer thereof as soon as possible on the first page of the Portal or by email to the email address provided by the Buyer concerned.
In such a case, the applicable GTCs are those in force at the time of validation of the order for the purchase of Tickets via the Portal, in addition to any subsequent modification linked to questions of security or public order which would actually be brought to the attention of the Purchaser after the purchase of the Ticket.

12.2 Non-waiver and independence of clauses

If HOPSCOTCH CONGRES fails to exercise all or part of its rights with regard to a Ticket Holder, by virtue of these GCS, does not constitute a waiver of its subsequent exercise. If any of the clauses of the GTCS should be declared null and void or inapplicable for any reason whatsoever, the following provisions shall apply or, the other clauses would nevertheless remain in force.

14- APPLICABLE LAW – DISPUTE

The GCS are governed by French law.
In the event of any dispute or litigation of any nature whatsoever in connection with the GTCS, the Buyer is invited to contact HOPSCOTCH CONGRES as a matter of priority in order to seek an amicable solution by sending his/her complaint in writing to the following address: [email protected].

In all cases, including in the event of failure of the attempt to settle the dispute amicably with the HOPSCOTCH CONGRES customer service department, the Purchaser is informed of the possibility of resorting to a conventional mediation procedure or any other alternative dispute settlement method. HOPSCOTCH CONGRES has joined the Mediation Service of the Professional Mediation Society via UNIMEV (Union Française des Métiers de l’Evénement) whose contact details are as follows: Médiateur-Consommation-smp, 24, rue Albert de Mun, 33000 Bordeaux. The mediator can be contacted directly via this link https://www.mediateur-consommation-smp.fr/demander-une-mediation/. The solution proposed by the mediator is not binding on the parties, who remain free to withdraw from the mediation process at any time.

The Buyer may also submit a dispute relating to an online order to the « Online Dispute Resolution » (ODR) platform accessible at the following address: https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=FR.
Any dispute that cannot be settled amicably will be brought before the competent court.
